Complete Streets Passes Legislature Unanimously, Cuomo Expected To Sign

Complete streets legislation passed both houses of the state legislature unanimously yesterday. With Governor Andrew Cuomo expected to sign the legislation, safer and more inclusive road design should be coming soon to streets across the state.

“Everyone knew that something had to be done,” said AARP New York legislative director Bill Ferris, “so the political will was there.” In the five largest upstate counties, a pedestrian is killed by a car every ten days. On Long Island, a pedestrian is killed once a week, and in New York City, once every two and a half days. Older pedestrians are disproportionately killed in traffic crashes.

Complete streets legislation would require planners to take account of all users, including those on foot, on a bicycle, or with limited mobility, when designing a road that receives state or federal funds.

After stalling out in the Assembly in the past, the complete streets bill passed this year due to some changes to the legislation’s language and support from the governor’s office, said Ferris. “The argument that it was an unfunded mandate was put to bed,” he explained, by including a provision clarifying that municipalities wouldn’t have to spend more on complete streets projects than what was already allocated from state and federal funding. Since the governor’s office participated in the crafting of that language, explained Ferris, “we believe that the governor will sign this into law.”

In addition to support from Cuomo’s office, the complete streets bill was able to continue forward in the Senate despite the change Democratic to Republican control, thanks to support from the new chair of the transportation committee, Charles Fuschillo. “Senator Fuschillo picked up the reins on this issue from last year and pushed it over the top,” said Ferris.

Assuming that the complete streets bill is signed into law, Ferris said that AARP will next be looking into ensuring that there is sufficient funding for pedestrian and bike projects and the state DOT’s Safe Seniors program.

How Seniors Get Stuck at Home With No Transit Options

According to AARP, 88 percent of seniors want to stay in their own homes as long as they can. But where are those homes? In auto-dependent suburbs. That’s where most Baby Boomers grew up, in the postwar era, and that’s where most of them have stayed – even as the largest (and longest-living) generation ever enters its golden years.

However, more than 20 percent of seniors (age 65 and up) do not drive at all. In the spread-out, transit-poor communities where many of them live, seniors who don’t drive miss out on countless opportunities. According to a report released today by Transportation for America called “Aging in Place: Stuck Without Options”:

Absent access to affordable travel options, seniors face isolation, a reduced quality of life and possible economic hardship. A 2004 study found that seniors age 65 and older who no longer drive make 15 percent fewer trips to the doctor, 59 percent fewer trips to shop or eat out, and 65 percent fewer trips to visit friends and family, than drivers of the same age.

The Center for Neighborhood Technology conducted the analysis for the T4A report, finding that a large proportion of seniors lack transit access currently, and that in 2015, just a few short years away, 15.5 million seniors will find themselves without transportation options

“My generation grew up and reared our children in communities that, for the first time in human history, were built on the assumption that everyone would be able to drive an automobile,” said John Robert Smith, former mayor of Meridian, Mississippi and co-chair of Transportation for America.

Assembly Kneecaps Complete Streets; Senate Passes Hayley & Diego’s Law

Just when you thought the State Assembly was safe for forward-thinking transportation legislation, Rochester rep David Gantt, the Transportation Committee chair formerly of bus cam-killing fame, has thrown a wrench into attempts to pass a complete streets bill.

The complete streets bill would require almost all new and reconstructed roads in the state to accommodate pedestrians, cyclists, and people with limited mobility. The bill is a top priority for street safety advocates and has a very high-profile champion in AARP.

The legislation seemed to move forward today, when the Senate passed the bill, sponsored in that chamber by Sen. Martin Dilan, by a vote of 58-3, according to AARP legislative director Bill Ferris. 

But Gantt, technically the bill's sponsor in the Assembly, had made a few amendments to it this Tuesday, before passing it out of his committee. Gantt's edits would drastically scale back the bill, covering only roads under the state DOT's jurisdiction. "It wouldn't cover any local or county roads," explained Ferris. Both houses have to pass the same bill for it to become law.

According to the Albany Times Union, Dilan, Gantt, and the state DOT are currently negotiating a compromise, which Ferris called an encouraging sign. AARP is urging the Assembly to take up the Senate's bill, but barring that, said Ferris, "we certainly think there should be a negotiation on this bill before the end of the session."

The good news in Albany today: Hayley and Diego's Law passed the Senate by a vote of 39 to 22. It now goes to the governor's desk. If Paterson, who has a record of supporting traffic safety, signs the bill, law enforcement will have a new option for bringing charges against drivers who injure pedestrians or cyclists. In cases where prosecutors may hesitate to bring charges like criminally negligent homicide, Hayley and Diego's Law would create a new middle ground -- the charge of "careless driving" -- making it more likely that dangerous drivers will face consequences for their actions. We have a request in with the governor's office to determine his position on the bill.

Campaigns for Smart Growth and Complete Streets Heat Up in Albany

The campaign to rein in sprawl and build more livable communities across New York state intensified yesterday, as advocates redoubled their efforts to pass two critical pieces of legislation in Albany. Groups working to advance complete streets legislation, including AARP and the Tri-State Transportation Campaign, and those pushing for statewide smart growth policies, such as Empire State Future, announced they will be teaming up to pass both bills.

The complete streets bill, sponsored by Brooklyn Senator Martin Malavé Dilan, would require that all new and reconstructed roads "accommodate all users," old or young, whether they walk, bike or drive. If passed, the law would "make complete streets the norm rather than the exception," said Nadine Lemmon, Tri-State's Albany legislative director. As Streetsblog reported last month, the legislation is moving quickly through the State Senate, but hasn't progressed beyond the Assembly transportation committee, chaired by Rochester Democrat David Gantt

The public infrastructure act, sponsored by Westchester County Senator Suzi Oppenheimer, Brooklyn Senator Velmanette Montgomery and Buffalo Assembly Member Sam Hoyt, would shift state infrastructure spending -- on roads, sewers, schools and housing -- away from far-flung sprawl and toward projects in line with smart growth principles. More than a dozen state departments, agencies, and authorities -- including heavyweights like the state DOT, the Port Authority, the Department of Education and the Empire State Development Corporation -- will be required to focus their spending on existing infrastructure in developed areas.

Under the smart growth bill, infrastructure projects would also need to protect the state's environmental resources, foster compact, mixed-use development, and reduce automobile dependency. Agency heads can only ignore these criteria if they sign a written justification of their decision. "We're going to make it very hard to build another sewer line into another greenfield," said Peter Fleischer, the executive director of Empire State Future, New York's smart growth coalition. 

Fleischer added that unlike past smart growth legislation that's come out of Albany, this one has some teeth. "It clearly instructs state departments, agencies, and corporations," he said. "It doesn't leave a lot of wiggle room."

Council Members Vow to Back AARP Pedestrian Safety Goals

Electeds and other officials gathered with representatives from AARP today to pledge support for street improvements and to call on Albany to pass complete streets legislation.

Kicking off a day of street surveys across the state, the group met at the corner of Ninth Avenue and 23rd Street, an intersection that had been particularly hazardous for the older residents of the nearby Penn South co-op.

One Penn South resident recounted her memories of living above the intersection before a redesign of the corridor brought refuge islands along Ninth to protect both pedestrians and cyclists. "Every time I heard a siren on Ninth Avenue," she said, "I ran out to see if it was one of our seniors."

Council Speaker Christine Quinn praised "the success we've had at 23rd and Ninth," and promised that the city would "replicate" it. "I'm looking forward to more safely strolling across intersections across the city," Quinn said. Quinn also noted the development of Age-Friendly NYC, a set of 59 initiatives to help New York City become more hospitable to a growing senior population. Traffic calming and street redesigns were an important piece of that document.

AARP's top pedestrian safety priority is complete streets legislation working its way through the state legislature. That bill, which has the support of the chairs of the transportation and aging committees in both the Assembly and Senate, would ensure that all streets statewide are designed with the needs of pedestrians, cyclists, people with disabilities, and transit riders in mind.

Seniors Survey Manhattan’s Deadliest Street

Hours after the Tri-State Transportation Campaign released a report yesterday identifying New York's deadliest roads, 13 AARP volunteers surveyed part of Third Avenue in an effort to make walking in New York safer.

The surveyors braved the January cold to spend their afternoon standing on the corner of Third and 49th Street, clipboards and stopwatches in hand, documenting the conditions at the intersection. Tri-State's report revealed that nine pedestrians were killed on Third Avenue between 2006 and 2008, making it one of the deadliest streets for pedestrians in downstate New York. A 58-year-old man was killed at the survey site on February 21, 2008.

Third Avenue is seven lanes wide at this location, so it's perhaps no surprise that so many tragedies occur there. Small fixes, though, could make a big difference. Volunteer Marlene Ramsey identified the crosswalks, badly in need of repainting and more visible zebra stripes, as the biggest problem with the intersection. Standing next to her, Alice Wade requested countdown timers for walk signs. Without them, she said, "I have to rush across the street and be scared I'll fall."

Some of the surveyors had personal experience with the hazards of Third Avenue. Volunteer Bobby Lee, who lives between Second and Third Avenues, explained his motivation for fighting for safer streets. "There was an older adult in my neighborhood who got run over by a bus," he said. "The bus driver was traumatized and the older adult was dead." Susan Ryckman, who lives on Third Avenue, reported, "I had two close calls walking here today. It really is dangerous."

AARP Joins Campaign to Reform National Transpo Policy

AARP announced today that it will join the Transportation for America campaign to advocate for a "broad restructuring" of national transportation policy. In a letter sent to Congressional leaders last week [PDF], AARP said that it is "working to enable older adults to live independently in their homes and communities throughout their lifespan, and transportation is critical to maintaining the community connections that make that possible."

Forty million Americans over the age of 50 belong to the organization, which is increasingly focused on the next federal transportation bill. "America is aging rapidly and transportation policy and spending must acknowledge this demographic shift," said AARP's Nancy Leamond in a press statement. "The upcoming transportation authorization can help the nation prepare both for its graying years and a greener future by making roads safer for drivers of all ages and also offering more user friendly options for pedestrians and transit users."

AARP's publications have been turning an eye toward the benefits of reducing car dependence and making streets safer for older Americans. Recent articles in the AARP Bulletin have examined Safe Streets for Seniors programs and the need to invest stimulus funds in infrastructure for walking, biking, and transit. An ongoing collaboration with Project for Public Spaces produced a series of three books about how citizens can improve their streets.
