So there are two possible useful actions to take.

One would be to get the feds involved and try for some way to try this violent dude again. I don’t much care for that, as it smacks of double jeopardy.

The other is to get a civil lawsuit against the guy and have a jury award damages. There’s no pleading out of civil court. With any luck, he’ll never get a whole paycheck again.

I don’t know that boycotting the state of North Carolina will do much of anything. Especially when you consider how Asheville is one of the most progressive places in the south. As a frequent visitor, I’d see lots of “Keep Asheville Weird” stickers on cars and street signs, for example. So it’s surprising for this news to come out of a place that seems so much more enlightened than it would if it happened in Hickory, NC, the jurisdiction of our good friend Patrick McHenry (remember him?: http://www.streetsblog.org/2007/08/09/congressman-ridicules-bikes-as-19th-century-solution/).

Kaja, you’ve just stated the exact problem, which unfortunately doesn’t justify the travesty of justice and humanity that is this situation. The sentence shouldn’t have been reduced. Nor should the judge have suspended most of that sentence. End of story. As for the idea of over-crowded prisons…yes, our prisons are over crowded, but it seems to me (and I don’t have a citation for this) that most inmates are non-violent drug offenders and the like. Mr. Diez is a violent criminal offender. On the subject of it being worse because the victim is a cyclist…it’s not worse, because no matter who the victim is Mr. Diez still a terrible person. As a cyclist, however it is especially tragic to my community and I because we are seen by many people as annoyances who deserve physical harm. I wish I were exaggerating, but that is the view of many people made evident by the daily harassment and endangerment we face.

He’s actually a much more deserving candidate for the death penalty or life without parole than many murderers. While many murders occur in a unique crime-of-passion context that’s unlikely to repeat for that offender, the offender in this case is overwhelmingly likely to shoot people again and next time he won’t miss.
