I mean, he <i>did</i> have to swerve to avoid that other car. I've asked this here before, but let me ask again: what other piece of machinery might one be permitted to operate in such a way without facing any consequences? If I was out cutting down a tree with a chain saw and a bee flew around my head, and I swatted at the bee and accidentally cut off the leg of a passerby, do you think I wouldn't face at least some sort of recklessness charge? Somebody -- either the driver or the other car pulling out of the driveway -- created a hazardous situation, and was responsible for what happened, and negligent.
