It is only by chance that his victim survived this accident. The law needs to be changed to be stricter against drunk drivers. Note this quote from the police, which makes no sense at all unless you operate under the assumption that a bicyclist is "guilty until proven innocent." Plus, the guy's dead, so why not say it was his fault? Lt. "The bike was between the truck and the curb," Call said. "Because nobody actually saw the whole thing, we're leaning toward the bicycle hitting the truck." Chris, I agree. They were traveling in the same direction and the cyclist's back wheel is the part that is damaged in the photo. I believe it is the motorist's responsibility to pass when it is safe to pass. If the cyclist indeed swerved while being passed and was hit by the rear wheels of the truck, how responsible is a cyclist for holding a perfectly straight line when someone passes closely?
